Privacy Policy

This policy is effective as of 31 January 2025.

This Privacy Policy explains how Salesmotion Limited (referred to as “Salesmotion,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information in connection with our websites, web applications, and other online or offline offerings (collectively, the “Services”). By using our Services, you agree to the terms of this Privacy Policy.

Important Note: Where we process data on behalf of our customers (e.g., storing or analyzing business contact information in our database), our Data Processing Agreement (“DPA”) (and the contracts we have in place with our customers) govern such data processing. This Privacy Policy applies primarily to personal information we control as a “Controller,” such as data gathered from our website visitors or direct business contacts.

1. Scope & Updates

Scope

This Privacy Policy covers how we collect and handle personal information in our capacity as a Controller, for example when you visit our website, request a demo, or communicate with us. For data we process solely on behalf of our clients, the client’s own privacy policy governs.

Changes to this Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you (e.g., via email or notice on our website). Your continued use of our Services indicates acceptance of any revised Privacy Policy.

2. Personal Information We Collect

The categories of information we collect depend on how you interact with our Services and applicable law. We collect personal information in these ways:

Information You Provide to Us

  • Account Creation: Name, email, password, job title, or other professional details if you register for an account or request a demo.
  • Communications: If you contact us by email, webform, or chat, we may collect your contact details and any other information you submit.
  • Purchases & Billing: If you purchase our Services, we may collect necessary billing information (e.g., payment details) via third-party payment processors.
  • Surveys or Events: If you participate in surveys or events, we collect the information you choose to provide.

Information Collected Automatically

  • Device & Usage Data: IP address, browser type, device identifiers, pages viewed, time spent on pages, and other usage statistics.
  • Cookies & Tracking Technologies:
    • We use cookies and similar tracking technologies for essential functionality (e.g., enabling user logins, remembering preferences), analytics (understanding site usage), and—where lawful—personalizing content or advertising.
    • Managing Cookies: Most browsers automatically accept cookies, but you can modify your browser settings to refuse cookies or alert you when cookies are being set. Disabling cookies may affect site functionality. Where required by law, we obtain consent before setting certain cookies.

Information from Other Sources

  • Publicly Available Data: We may gather publicly available business contact details from professional websites, social networks, or third-party services.
  • Third-Party Services: If you integrate or interact with third-party services (e.g., sign-in via a social network), we may receive certain information depending on your settings.

3. How We Use Your Information

We use personal information for various legitimate interests, including to:

  • Provide and Improve the Services: Manage user accounts, respond to requests, authenticate logins, and generally operate and enhance our offerings.
  • Communicate with You: Send product updates, respond to inquiries, provide support, or inform you of policy changes.
  • Facilitate Transactions: Process billing or payments and handle related customer service.
  • Analytics & Personalization: Understand how users interact with our Services to improve user experience and, where lawful, tailor content or advertising.
  • Marketing: Send marketing communications about new features or products, subject to applicable law. You can opt out at any time.
  • Compliance & Protection: Protect our rights and safety or those of others, detect fraud, and comply with legal obligations.

4. How We Disclose Personal Information

  • Service Providers: We share personal information with vendors who help operate the Services, such as cloud hosting, payment processors, analytics providers, and email service providers.
  • Clients: When we act as a Processor on behalf of a client, we share data only under the client’s instructions (see our DPA).
  • Affiliates & Business Partners: We may share information with our corporate affiliates or with partners where necessary to provide Services or co-offer products.
  • Legal & Compliance: We may disclose personal information if required by law, regulation, or to protect our rights, safety, or property.
  • Business Transactions: In the event of a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction.

5. Your Privacy Choices & Rights

Depending on your location and applicable law, you may have some or all of the following rights regarding your personal information:

  • Access & Portability: Request a copy of the personal information we hold about you.
  • Correction: Ask us to rectify inaccurate or incomplete data.
  • Deletion: Request that we delete certain data (subject to legal constraints).
  • Objection or Restriction: Object to or request restriction of certain processing.
  • Withdraw Consent: If we rely on consent, you can withdraw it at any time (which won’t affect processing already done).
  • Opt Out of Marketing: You can unsubscribe from marketing emails by clicking the link in each message or contacting us.

To exercise these rights, email us at hi@salesmotion.io. We will verify your identity before addressing your request, as required by law.

If you believe our processing of your personal information violates applicable law, you also have the right to lodge a complaint with the Information Commissioner’s Office (ICO) in the UK or another relevant supervisory authority.

6. Security Measures

We implement technical and organizational measures designed to protect personal information against unauthorized access, destruction, or alteration. However, no method of transmission or storage is entirely secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately at hi@salesmotion.io.

7. International Data Transfers

We are headquartered in the United Kingdom but may process data worldwide. Where we transfer personal information outside the UK/EEA (e.g., to U.S.-based service providers), we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) in compliance with GDPR. Where required, we may conduct Data Protection Impact Assessments (DPIAs) and implement supplementary security measures. For more information, see our DPA or contact us.

8. Additional Information for U.S. Residents

  • California Residents: We do not “sell” personal information as defined by the California Consumer Privacy Act (CCPA). If you are a California resident, you may have additional rights regarding access, deletion, and non-discrimination. Please contact us to exercise your rights.
  • Nevada Residents: We do not currently sell personal information as defined by Nevada law. You can still request to opt out of any future sale by contacting us.

9. Automated Decision-Making

We do not engage in fully automated decision-making that has legal or similarly significant effects. If we implement such processes, users will have the right to request human intervention.

10. Children’s Data

Our Services are not directed to individuals under the age of 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us at hi@salesmotion.io, and we will promptly take steps to delete such information.
